About This Policy

This Public and Products Liability Policy provides essential protection for specialist occupation businesses against legal liability for injury to third parties and damage to their property arising from your business operations and the products you supply.

What's Covered

Core Coverage

You are protected for compensation you're legally liable to pay for:

Personal Injury

Bodily injury, death, disease, illness, mental anguish, false arrest, wrongful imprisonment, wrongful eviction, and assault/battery (when protecting persons or property).

Property Damage

Physical damage to or destruction of tangible property belonging to third parties, including loss of use of that property.

Advertising Injury

Libel, slander, defamation, breach of misleading conduct provisions, infringement of copyright/titles/slogans, unfair competition, and invasion of privacy in your advertising activities.

Important: Occurrence-Based Coverage

This policy operates on an "occurrence" basis. This means the personal injury, property damage, or advertising injury must first occur during the policy period. Claims can be made after the policy expires, as long as the injury or damage happened during the policy period.

Automatic Extensions

Your policy includes six valuable automatic extensions at no extra cost:

Claims Preparation Costs

Reasonable costs for preparing claims, subject to our prior consent (sub-limit applies).

Court Attendance Costs

Up to $500 per day, per employee required as a witness (sub-limit applies).

Cross Liabilities

Each named insured treated as if separately insured.

Indemnity to Others

Coverage extends to legal representatives, plant hire owners, and welfare organization officers.

Care, Custody and Control

Limited coverage for employee personal effects, leased premises, and property being worked on (sub-limit applies).

Overseas Personal Liability

Coverage for directors, officers, and employees on temporary business trips outside Australia.

Sudden and Accidental Pollution

Coverage is provided for pollution that is sudden, unexpected, and unintended. This extension does NOT apply to pollution occurring in the USA or Canada.

Major Exclusions

  • Abuse: Any acts of physical, mental, or sexual abuse
  • Professional Liability: Professional services, advice, design, plans, or specifications
  • Cyber Liability: Cyber incidents, cyber attacks, denial of service attacks, data breaches
  • Employer's Liability: Injuries to employees or workers' compensation claims
  • Faulty Workmanship: Cost to re-perform, correct, or improve your work
  • The Product Itself: Damage to the product you supplied or its unsuitability
  • Recall Costs: Costs of recalling, removing, or replacing products
  • Care, Custody and Control: Property owned, leased, or in your control (except under the extension)
  • Motor Vehicles: Vehicles requiring compulsory insurance
  • Property Ownership: Buildings, land, aircraft, watercraft you own or operate
  • US Jurisdiction: Claims brought in US courts or US-based operations
  • Fines and Penalties: Fines, punitive, or exemplary damages
  • War and Terrorism: War, terrorism, or related actions
  • Asbestos & PFAS: Asbestos or PFAS contamination
  • Communicable Disease: Disease transmission or related costs
  • Pollution: General pollution (except sudden and accidental)

Advertising Injury Exclusions

Advertising injury coverage excludes:

  • Failure of contract performance
  • Trademark or service mark infringement (except titles/slogans)
  • Incorrect product descriptions or advertised prices
  • Failure of products to meet advertised performance

Your Obligations

Notification Requirements

You Must Notify Us As Soon As Reasonably Practicable Of:

  • Any occurrence, loss, or event that may give rise to a claim
  • Any claim made against you
  • All legal documents and communications received

After an Occurrence or Claim

  • Do not: Admit liability or make offers/payments without our consent
  • Do: Take reasonable measures to minimize injury or damage
  • Do: Retain all evidence and supporting documents
  • Do: Cooperate fully with us in investigating and defending claims
  • Do: Forward all legal documents immediately

Changes to Your Business

You must notify us immediately of:

  • Changes to your business activities
  • Bankruptcy, receivership, or external administration
  • Change of control (acquisition or merger)
  • Inability to pay debts

Limits, Excess & Defence Costs

How Limits Work

Public Liability: The limit shown in your schedule is the maximum we will pay for any one occurrence.

Products Liability: The limit shown is the maximum we will pay in total for all occurrences relating to your products during the policy period.

⭐ Defence Costs - Additional to Limit

Unlike many policies, defence costs are payable IN ADDITION TO the limit of liability. However, if total compensation exceeds the limit, we'll only pay a proportionate share of defence costs.

Excess

You are responsible for the first amount of any claim up to the excess shown in your schedule. The excess applies to both compensation and defence costs and remains uninsured.

Additional Important Information

Territorial Limits

Coverage applies worldwide unless otherwise stated in your schedule. However, important exclusions apply to:

  • Claims brought in United States courts
  • Products exported to the United States
  • Entities based in or operating in the United States

Duty of Disclosure

Before entering into this policy, you have a duty under the Insurance Contracts Act 1984 to disclose every matter you know or could reasonably be expected to know that is relevant to our decision to accept the risk. This duty also applies when renewing, extending, or varying the policy.

Cancellation

By You: You may cancel at any time with written notice. You'll receive a refund of unexpired premium unless a claim has been made or notified.

By Us: We may cancel in accordance with the Insurance Contracts Act 1984. You'll receive a proportionate refund unless a claim has been made.

Complaints & Disputes

If you have a complaint:

  • Stage 1: Contact your insurance intermediary or claims administrator
  • Stage 2: Contact Lloyd's Australia Limited if unresolved
  • External: Refer to the Australian Financial Complaints Authority (AFCA)
